State Representatives Gabe Okoye and Matt Reeves have expressed their approval of the recent House passage of House Bill 1292, a measure aimed at combating real estate fraud in Georgia. The legislation requires identification to be provided when deeds are recorded by individuals who are not licensed attorneys, financial institutions, or realtors.
Rep. Okoye emphasized the importance of the bill in protecting vulnerable individuals, stating, “The Georgia House has taken action to safeguard senior citizens and other vulnerable individuals from fraudsters seeking to unlawfully appropriate property.” He added, “This proactive approach reflects a dedication to justice and integrity within the real estate sector, safeguarding the rights and interests of all citizens.”
Similarly, Rep. Reeves highlighted the significance of HB 1292 in addressing fraudulent activities targeting senior citizens and homeowners, saying, “The Georgia House has acted to protect senior citizens, and to catch and punish predatory criminals who are trying to get their hands on real estate through deceptive and wrongful means.” He continued, “Implementing this measure would not only ensure the safety and security of older members of society but also send a clear message to those who seek to take advantage of them.”
The bill, co-sponsored by several other representatives including Speaker Jon Burns, Majority Leader Chuck Efstration, Minority Leader James Beverly, Rep. Deborah Silcox, and Majority Caucus Chairman Bruce Williamson, passed with bipartisan support on Crossover Day, February 29, 2024. It has been assigned to the Senate Judiciary Committee for further consideration.
HB 1292 mandates unlicensed individuals filing deeds to provide detailed information to Superior Court Clerks through the electronic filing system to prevent fraudulent activities related to deed filings. The bill aims to enhance the safety and security of property owners and deter fraudulent practices within the real estate sector.
